Shake shack is restricting its customers’ rights

Fast-food chain Shake Shack recently updated its terms of use agreement to include a binding arbitration agreement and class-action waiver denying customers their legal right to take companies to court.

These provisions are showing up across the fast-food industry, extending restrictive contracts to consumers through the rapid expansion of online services such as websites, mobile apps, and automated self-service kiosks.

Arbitration courts are a pay-for-play private justice system in which cases are overseen by judges hired by the company being sued, and the chances of consumers ever winning a lawsuit are extremely low — upwards of 90% of cases rule in favor of companies.

These contracts have spread across the economy, from health care to live entertainment. But until recently, fast-food chains were generally only able to wield them over their workers in employment contracts.

The digitization of ordering is driven by several factors that enable restaurants to rake in more profits. You may have noticed that every fast-food chain from Wendy’s to McDonald’s now wants you to order through their own company app, even if you’re picking up in person.

That’s because once the company gets into your phone, it can collect data, surveil your spending habits, and serve you personalized pricing to extract as much money as possible. Inside the store, automated kiosks are helping restaurants downsize their workforce and slash labor costs.

CFPB IT Failures Exposed

President Donald Trump's clampdown on the U.S. Consumer Financial Protection Bureau earlier this year has compounded IT security lapses at the agency through the cancellation of contracts, according to an audit report.

The information security program at CFPB -- which maintains sensitive and confidential data from investigations, the oversight of companies and complaints received from members of the public -- is "not effective," according to the Office of Inspector General, which also covers the Federal Reserve.

Note that there isn't any particular indication as to how these security breaches happened, but there was also a pretty significant breach some time earlier, in 2023, in which people's personal information might have been released. Remember, this was during the Biden administration.

The CFPB said an employee forwarded the personal information of more than a quarter-million consumers to a personal email account, an incident that the bureau described as a “major” breach. The employee, who was fired when the data breach came to light, sent spreadsheets with names and transaction-specific account numbers related to those 256,000 consumer accounts at a single institution, according to the bureau. The CFPB did not identify the now former employee.

By punting the issue into 2025, Democrats hoped they could secure a permanent extension of Obamacare subsidies. That plan backfired.

In response to the government shutdown hitting the one-month mark, an unnamed adviser to Donald Trump said that the president has “had it with these people [i.e., congressional Democrats], because he knows they’re playing politics.” He’s right — but the administration hasn’t articulated the half of it.

Democrats have shut down the government due to their demands that Republicans extend enhanced Obamacare subsidies set to expire on Dec. 31. Such a demand would give a bailout to insurance companies totaling $350 billion plus interest. But it would also give a political bailout to Democrats themselves, who ended up in this situation only because they thoroughly mis-calculated when and how to seek a subsidy extension.

NSA Faces Leadership Crisis and Staff Reductions, Impacting Operations and Morale

"That’s what happens when your boss disappears, and then some of your lead unicorns also disappear,” one person said.

A combination of strains are threatening morale and even long-term capabilities at the National Security Agency, former U.S. national security officials and others with knowledge of changes at the signals-intelligence agency told Nextgov/FCW.

Among them are leadership gaps, program cuts, buyouts, and the government shutdown that has furloughed workers.

The NSA has been without a permanent leader since Gen. Timothy Haugh was unexpectedly fired in April; the White House recently backed down on its plans to elevate Lt. Gen. William Hartman, who has led the NSA and U.S. Cyber Command in an acting capacity ever since, said a person with knowledge of the matter.

The reversal was first reported by The Record, the news unit of cybersecurity firm Recorded Future.

The NSA’s top lawyer, April Falcon Doss, was also let go on the advice of right-wing activist Laura Loomer, and other leading officials have chosen to leave the agency and the combatant command.

A search to find candidates for various leadership positions at the agency continues. The person, recounting a recent retirement event for one senior officer who left NSA, put it bluntly: “They’re struggling to find work, and it was very depressing to be there.”

Virginia, Maryland, and Beyond: The Dangerous Consequences of Gender Identity in Locker Rooms

The Left has spent years telling women two contradictory things:

1. All men are rapists, so trust your gut instincts and avoid them at all costs, and
2. You must let men who say they're women into your locker rooms, lest we label you a bigot.

Those same Leftists insist that men would never abuse their laissez-faire locker room policies, and that only "trans women" would access private spaces, because they're really women. Now we have a case file of men cosplaying as women who have used these lax policies to abuse women.

In Virginia, registered sex offender Richard Cox had the schedules of children's swim classes on his phone and frequented female locker rooms in and around Arlington. Officials turned a blind eye to this because Cox "identifies" as a woman, despite the fact that he frequently exposed himself to women and girls.

Only after sufficient outrage is Cox finally facing charges, including indecent liberties with children, indecent exposure, child pornography possession, and sex offender proximity violations. Now there's another man in Maryland who abused women in a locker room.

When there's crime, I blame the criminal. But Dallas politicians blamed a business. Dale Davenport owned Jim's Car Wash. But five years ago, after a shooting at the property, the city ordered him to shut it down. Why did they target his car wash?

When I first investigated this story, Davenport told me he was a "model citizen," doing everything local politicians asked of him: "They said build a 6-foot fence. I built an 8-foot fence. Then they said, put up signs. I already had signs up, so I put up more signs. Then they told me to put up lights. I already had lights up, so I put up more lights."

That didn't stop the city from closing him down. "Murdered my business, is what the city of Dallas has done," says Davenport. Many cities have policies that allow them to close a business if the owner conceals crime. But Davenport didn't conceal anything. He did the opposite — when he saw crime, he called 911. The politicians then used his 911 calls as evidence against him.

A member of the city council in New York recently outlined a plan to allocate almost $200 million in taxpayer funds to be used to legally defend illegal immigrants from ICE and the Trump administration.

If you watch the video below, it is crystal clear that this woman and the people like her believe that their power supersedes the power of the federal government and federal immigration laws. It’s almost like these people think that New York City is a country within the country and that it belongs to them.

Officials from the Mayor’s Office of Immigrant Affairs (MOIA) then cited Vera Institute of Justice data showing it would cost $188.5 million to “provide services to every immigrant New Yorker,” broken down as $145 million for free legal counsel and $43.5 million for other immigration services.

In June, the city doubled this budget to about $120 million, and now MOIA wants multi-year contracts and even more money—with Cabán urging that these networks operate “with the broadest, lowest barrier access to dollars as soon as possible.”

Congressional Republicans need to do something worthy of voter support, and the party has to sharpen its early-voting ground game..

The third time wasn’t the charm for Republican businessman and former New Jersey lawmaker Jack Ciattarelli in Tuesday’s race for the Garden State’s next governor. And Virginia didn’t elect its first black governor — a woman at that. New Jersey and Virginia remain squarely in the blue state column.

But Tuesday’s election, contrary to the left and their corporate media partners, wasn’t an early verdict on Republican President Donald Trump or a bellwether of next year’s midterms.

The Democratic National Committee proclaimed far-left Abigail Spanberger’s victory over Republican Lt. Gov. Winsome Earle-Sears in Virginia’s race for governor “another sign that voters are rejecting Donald Trump and his Republican allies’ extreme agenda that is raising health care and utility costs and destroying jobs.” It’s not a sign, and the agenda stuff, per usual, is dizzying political spin.

Air Travel Nightmare: FAA to Cut Thousands of Flights During Schumer Shutdown

The Federal Aviation Administration (FAA) announced that thousands of flights will soon be cut at major airports across the country as part of the latest fallout from the ongoing Schumer Shutdown.

On Wednesday, the FAA said that, starting on Friday morning, it would reduce "air traffic by 10%" across 40 "'high-volume' markets" to maintain safety and ease the pressure on Air Traffic Controllers, who have been working without pay due to the shutdown, causing major staffing shortages.

"If the pressures continue to build even after we take these measures, we'll come back and take additional measures," FAA Administrator Bryan Bedford said.


Secretary of Transportation Sean Duffy echoed the sentiment, and said they had no choice but to reduce flights before they are forced to react to a disaster.

Britain's attempt to launch a £33 million climate project in Uganda ended in disaster for Africans. The Ugandan authorities used British money to destroy crops, leaving African farmers “on the brink of starvation.”

According to local residents, British taxpayers' money was used to destroy crops, trees, and homes as part of a project that, according to its organizers, was aimed at restoring wetlands in Uganda. The project was implemented through the Green Climate Fund (GCF), which received £2.6 billion. The total amount allocated by the UK government for international climate finance was £11.6 billion.

However, instead of improving the situation in the villages, the project led to the destruction of agriculture and the threat of starvation among farmers. Residents claim that their land was illegally classified as wetlands, and local authorities, protected by police and soldiers, destroyed their crops and homes. In one case, a 70-year-old man died of a stroke after seeing his crops being cut down.

Residents of eight villages in southwestern Uganda have filed a complaint with the GCF's Independent Redress Mechanism (IRM). They claim that in November 2023, local authorities violated their rights by forcing them to face the consequences of the destruction of their land, where they grew trees, bananas, coffee, corn, beans, rice, and other crops.

The leader of one of the communities noted that they have lived on this land for more than 150 years and that the project, instead of helping them, has only brought them suffering. He also emphasized that those who lost their homes and land were not offered compensation.

A lawyer representing the local residents claims that the need to protect the wetlands was exaggerated in order to obtain funding and that the project has not benefited local farmers, as they knew nothing about the wetlands before officials began cutting down their crops.

In addition, there have been complaints about the actions of security forces in other villages, as well as the deaths of a 17-year-old worker and an eight-year-old girl at construction sites.

Nevertheless, British officials continue to cite the project as an example of successful international aid under the Global Biodiversity for Climate Center (Defra).

It is also reported that the UK has invested in other controversial projects, such as a £52 million road through the jungle in Guyana and solar panels for expensive hotel chains.

A "vile creature?" After the attacks we have seen on Republicans, this is the type of language she chooses to use? The CNN anchor, Elex Michaelson, at least followed up with a question, allowing her to clarify her position, which she doubled down on.

I do wish Michaelson had followed up once again to give examples of true evil and forced her to make the comparison between President Trump and actual evil on the earth. This type of dark rhetoric that Democrats continue to use towards President Trump and administration officials like Deputy Chief of Staff for Policy and Homeland Security Advisor Stephen Miller is extraordinarily dangerous, and Pelosi has to know this.

Metropolitan Police officer Grant Long (34) was caught during a special operation, where he discussed his sexual interest in newborns and children over the age of five in correspondence with another “pedophile” and tried to persuade a “schoolgirl” to engage in such activities. In the end, he avoided a prison sentence.

Here it is, the new rehabilitation program for British police officers: if you catch criminals but at the same time share your experiences of “previously enjoying newborns” in private correspondence, you simply receive a reprimand.

Officer Long apparently decided that his uniform was not only protection from bullets, but also a license for the most vile fantasies. He was caught red-handed, his phone with compromising correspondence was confiscated, but the court apparently considered that discussing sex with babies was simply a “gross violation” and not a criminal offense.

NB: It seems that the British justice system has finally found a way to combat pedophilia in the police force — simply turn a blind eye to it. We can only hope that the next child to whom such a law enforcement officer shows “interest” will not be a real child, but another undercover police officer.

Judge Orders Bureau of Prisons to Provide Gender Confirmation Surgery to Transgender Inmate Convicted of Child Offenses

A federal judge has ruled that the Bureau of Prisons (BOP) must provide sex change procedures to a convicted pedophile who recently began identifying as transgender.

Brian Buckingham, 47, is serving more than 21 years in prison for sexually abusing his 10-year-old son and producing child sex abuse images. Shortly before sentencing, Buckingham began identifying as “Nani Love” and claimed to be female.

In court filings, Buckingham claimed that being unable to access previously provided “gender-affirming” treatments, like hormone therapy, had worsened his depression and suicidal thoughts, The Post Millennial reported.

Attorneys for Buckingham argued the sex change procedures were “medically necessary” to treat gender dysphoria and that denying Buckingham access to them is a violation of his Eighth Amendment rights.

New York City Fire Commissioner Robert Tucker will leave his post next month, announcing his resignation the day after Zohran Mamdani was elected to be the city's next mayor.

Reports are that perhaps as many as a million New Yorkers may jump ship and move elsewhere rather than live under a Marxist mayor. We don’t know Chief Tucker’s exact reasoning at this time, but I expect it will be the first of many such departures and resignations.
